1.1 These General Terms and Conditions apply to all offers, orders and agreements of Gezennig.

1.2 Accepting an offer or placing an order means that you accept the applicability of these conditions.

1.3 Deviations from the provisions of these terms and conditions are only permitted in writing, in which case the remaining provisions will remain in full force.

1.4 All rights and claims, as stipulated in these Terms and Conditions and in any additional agreements for the benefit of Gezennig, are also stipulated for the benefit of intermediaries and other third parties engaged by Gezennig.

2.1 All Gezennig offers are non-binding, and Gezennig expressly reserves the right to change prices, particularly when required by (legal) regulations. See also Article 3.6.

2.2 An agreement is only concluded after Gezennig accepts your order. Gezennig reserves the right to refuse orders or impose certain conditions on delivery, unless expressly stated otherwise. If an order is not accepted, Gezennig will notify you within five (5) business days of receipt.

3.1 The stated prices for the products and services offered are in
Euro, including VAT and including handling and shipping costs, if any
taxes or other levies, unless otherwise stated or agreed in writing

3.2 Payment must be made without discount or
compensation within ten (10) days after invoice date if the deliveries
within the Netherlands, and within ten (10) days after the invoice date

If the prices for the products and services offered increase in

4.1 The delivery times specified by Gezennig , namely;

6.1 You must fully and unconditionally respect all intellectual and industrial property rights that apply to the products supplied by Gezennig .
6.2 Gezennig
does not guarantee that the products supplied to you do not infringe
any (unwritten) intellectual and/or industrial property right of
third parties.

7.1 You are obligated to examine the products upon delivery to determine whether they conform to the agreement. If they do not, you must notify Gezennig in writing/by email as soon as possible, and in any case within seven (7) days (including weekends) of delivery, or after the defect could reasonably have been detected. (PLEASE NOTE: JEWELRY CANNOT BE EXCHANGE/ROUTED FOR HYGIENE PURPOSES.)
7.2 If it has been demonstrated that the products do not correspond to the agreement, Gezennig has the option to replace the products in question upon return with new products if in stock.
7.3 If you do not wish to purchase a product for any reason, you, as a private individual, have the right to return the product to Gezennig within seven (7) days (including weekends) after delivery. The following conditions apply: the item must be unused and undamaged and returned complete in its original packaging. You are responsible for the return shipping costs.

8.1 Gezennig guarantees that the products to be delivered meet the usual requirements and standards that can be set for them and are free from any defects whatsoever.
8.2 If the items to be delivered do not meet this warranty, Gezennig will, at Gezennig 's discretion, replace or repair the item within a reasonable period after receipt thereof or, if return is not reasonably possible, after written notice of the defect by the buyer.
8.3 The warranty mentioned herein does not apply if the defect has arisen as a result of improper or inappropriate use or if, without the written permission of Gezennig , the buyer or third parties have made or attempted to make changes to the product or have used it for purposes for which this product is not intended.
8.4 In addition to these warranty provisions, statutory warranty provisions remain in force.

9.1 Gezennig shall not be liable for any misunderstandings, mutilations, delays or improper transmission of orders and communications resulting from the use of the Internet or any other means of communication in the traffic between you and Gezennig , or between Gezennig and third parties, insofar as this relates to the relationship between you and Gezennig , unless and insofar as there is intent or gross negligence on the part of Gezennig.

10.1 Without prejudice to its other rights, Gezennig has the right, in the event of force majeure, to suspend the execution of your order or to terminate the agreement without judicial intervention, at its own discretion, by notifying you in writing and without Gezennig being liable for any damages, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
10.2 Force majeure means any shortcoming that cannot be attributed to Gezennig , because it is not its fault and it is not its responsibility under the law, legal act or generally accepted views.
10.3 Gezennig is not responsible for counterfeit goods. Goods bearing logos of international brands such as Chanel, Balenciaga, and Gucci. The cost of "counterfeit" products will be recovered from the agency that delivered the goods.

11.1 If you provide Gezennig with an address in writing, Gezennig is entitled to send all orders to that address, unless you provide Gezennig with another address in writing to which your orders should be sent.
11.2 If Gezennig has permitted deviations from these terms and conditions, either tacitly or explicitly, for a short or long period of time, this does not affect its right to subsequently demand immediate and strict compliance with these terms and conditions. You may never assert any rights based on Gezennig's flexible application of these terms and conditions.
11.3 If one or more of the provisions of these terms and conditions or any other agreement with Gezennig are in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new, legally permissible, comparable provision to be determined by Gezennig .
11.4 Gezennig is authorised to use third parties in the execution of your order(s).

12.1 All rights, obligations, offers, orders and agreements to which these terms and conditions apply, as well as these terms and conditions, are exclusively governed by Dutch law.
12.2 All disputes between the parties shall be submitted exclusively to the competent court in the Netherlands.

13.1 Reproduction of any images or parts of images available on this website without the express permission of the author is strictly prohibited under copyright law.
